If you are a person or entity residing in the United States who purchased one or more of the pet food products made by Midwestern Pet Foods, Inc. and/or Nunn Milling Co., you may be entitled to monetary benefits under a Class Action Settlement. Payment amounts may be reduced depending on the number of valid claims submitted.

A Settlement has been reached in a class action lawsuit against Midwestern Pet Foods, Inc. and Nunn Milling Co. ("Defendants") that alleged Defendants marketed and sold pet food products which may have been contaminated with aflatoxin or Salmonella, which can cause serious illness, sickness, or death to pets. The Defendants deny the allegations in the lawsuit, and the Court has not decided who is right.

This website and the Long Form Notice advises you of the benefits that may be available to you under the proposed Settlement and your rights and options as a Settlement Class Member. Submit a Claim Form

The Claim Filing Deadline was August 3, 2023. Claims and supporting documents are no longer accepted.

The only way for you to get reimbursement for Pet Injury Claims and Consumer Food Purchase Claims is to timely submit a valid Claim Form. Payment amounts may be reduced depending on the number of valid claims submitted.

Ask to be Excluded

The Request for Exclusion Deadline was August 3, 2023. Exclusion Requests are no longer accepted.

Receive no reimbursement. Get out of this lawsuit but keep your individual right to sue. If you ask to be excluded, you will not be eligible for benefits from this Settlement, but you will maintain your right to pursue an individual claim against Defendants about the claims in this lawsuit.


The Objection Deadline was August 3, 2023. Objections are no longer accepted.

Comment in writing about why you like or don't like the proposed Settlement. You may comment in writing about why you like or dislike the proposed Settlement by sending a letter to the Settlement Administrator. In order to comment or object to the proposed Settlement, you must remain a member of the Settlement Class (i.e., you cannot ask to be excluded).

Do Nothing Receive no reimbursement. Give up your rights to sue. By doing nothing, you will not be eligible for reimbursement for Pet Injury Claims and/or Consumer Food Purchase Claims. You will also give up any rights to sue Defendants on an individual basis separately about the claims in this lawsuit.
Attend the Final Approval Hearing The Court held the Final Approval Hearing on August 21, 2023 at 11:00 a.m. CT, before Magistrate Judge Matthew P. Brookman, in the Winfield K. Denton Federal Building & U.S. Courthouse, Courtroom 301, 101 Northwest Martin Luther King Boulevard, Evansville, IN 47708.

On August 21, 2023, the Hon. Matthew P. Brookman signed the Order granting Final Approval of the Settlement.
